Residency through a victim visa: Who can benefit?

A U Visa allows crime victims who meet specific requirements to remain in the United States if, after becoming victims of the crime against them, they assist the police in arresting the criminal. This process is a testament to your assistance in bringing the criminal to justice. Therefore, do not hesitate to call the police and assist in the prosecution. Keep all police reports as part of your records. Finally, consult an attorney to understand your and your family’s rights to residency in the United States. A U Visa provides the following benefits:

  • You can legally live in the United States for four years. After three years of having a U Visa, you can apply for a green card to remain in the United States permanently. If you obtain a green card, you can eventually apply to become a U citizen.
  • With a U Visa, you can obtain permission to work in the United States.

 

It is important to note that a U Visa is not just for you. Some of your family members may also be able to obtain a U Visa. This provision ensures that you and your loved ones can face this difficult time together, providing a sense of security and unity.

In some states, such as California and New York, people with a U Visa may be eligible for certain public benefits.

Who can benefit from your U Visa?

If the victim is under 21 years of age:

  • Their parents
  • Their legally married spouse*
  • Their children (if unmarried and under 21 years of age)
  • Their unmarried brothers and sisters under 18 years of age

 

If the victim is 21 years of age or older:

  • Their legally married spouse*
  • Their unmarried children under 21 years of age

 

The U Visa is also a path to citizenship. Once your U Visa application is accepted, you are granted legal immigration status in the United States. Your temporary permanent residence permits four years of validity. After your third year as a U visa holder, you can speak with your U visa attorney about your eligibility for a green card.
